Hello and welcome to the Terms of Use (“Terms”) of MUSICIANS HASTAAKSHAR, with its registered office at 508, VISHWADEEP TOWER, DISTRICT CENTRE, JANAKPURI, NEW DELHI 110056 (“MUSICIANS HASTAAKSHAR”, “We”, ”Us”, or “Our”). MUSICIANS HASTAAKSHAR is an online marketplace for Members (defined below) to avail services that are provided by the Hosts (as defined below).

By accessing or using the website available at MUSICIANS HASTAAKSHAR, any subdomains or any other website through which MUSICIANS HASTAAKSHAR services are made available (“Website”) . Your agreement with us includes these Terms, Terms for Guests and Hosts and the Privacy Policy (collectively “Agreement”).

The Website and Application are collectively referred to as “Platform”

The expressions “You” “Your” or “User(s)” refers to any person who accesses or uses the Platform for any purpose.

IF YOU DO NOT AGREE WITH THESE TERMS, THEN PLEASE REFRAIN FROM USING THE PLATFORM. BY ACCESSING OR USING THE PLATFORM, YOU IRREVOCABLY ACCEPT THE AGREEMENT AND AGREE TO ABIDE BY THE SAME (AS UPDATED FROM TIME TO TIME).

User Eligibility

User(s) represent and warrant that they have the right to access or use the Platform. The Platform can only be availed by those individuals or business entities, including sole proprietorship firms, companies and partnerships, which can form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the Platform.

As such, natural persons below 18 years of age shall not register as a Member on the Platform and shall not transact on or use the Platform.

MyScoot reserves the right to terminate a User’s membership and / or refuse to provide User with access to the Platform if it is brought to MyScoot’s notice or if it is discovered that the User is under the age of 18 years or is breach of these Terms.

General Disclaimer

1. By use of the Platform, You agree that You meet with the Eligibility Criteria as detailed in Clause 1 (above) and that You are fully able and competent to understand and accept this Agreement as a binding contract and to abide by these Terms.
1. As the provider of the MUSICIANS HASTAAKSHAR Platform, MUSICIANS HASTAAKSHAR does not own, create, sell, resell, provide, control, manage, offer, deliver, or supply any Listings (as defined below) or Host Services(as defined below).
1. User should always exercise due diligence and care when deciding whether to participate in an Experience or Event or use other Host Services, accept a booking request from a Guest (as defined below), or communicate and interact with other Members, whether online or in person.
1. No joint venture, partnership, employment, or agency relationship exists between You and MUSICIANS HASTAAKSHAR as a result of this Agreement or Your use of the MUSICIANS HASTAAKSHAR Platform. These Terms do not and are not intended to confer any rights or remedies upon any person other than the parties.
1. To promote the MUSICIANS HASTAAKSHAR Platform and to increase the exposure of Listings to potential Guests, Listings and other Member Content (as defined below) may be displayed on other websites, in applications, within emails, and in online and offline advertisements.
1. To assist Members who speak different languages, Listings and other Member Content may be translated, in whole or in part, into other languages. MUSICIANS HASTAAKSHAR cannot guarantee the accuracy or quality of such translations and Members are responsible for reviewing and verifying the accuracy of such translations. The MUSICIANS HASTAAKSHAR Platform may contain translations powered by Google. Google disclaims all warranties related to the translations, express or implied, including any warranties of accuracy, reliability, and any implied warranties for merchantability, fitness for a particular purpose and noninfringement.
1. The placement and ranking of Listings in search results on the MUSICIANS HASTAAKSHAR Platform may vary and depend on a variety of factors, such as Guest search parameters and preferences, Host requirements, price and calendar availability, number and quality of Images, customer service and cancellation history, Reviews and Ratings, type of Host Service, and/or ease of booking.
  1. The access to or use of certain areas and features of the MUSICIANS HASTAAKSHAR Platform may be subject to separate policies, standards or guidelines, or may require that you accept additional terms and conditions. If there is a conflict between these Terms and terms and conditions applicable to a specific area or feature of the MUSICIANS HASTAAKSHAR Platform, the latter terms and conditions will take precedence with respect to Your access to or use of that area or feature, unless specified otherwise.
